Ι am sure they would. In my opinion a monetary settlement is the only solution. Activision can bankrupt Fizzer with years of trials. And win is not that sure.

That's the biggest concern tbh, the typical Big Guy vs Small Guy lawsuit. All they need to do is keep the lawsuit ongoing to a point where it's an acceptable budget for them but a crippling one for Fizzer, and they never have to win the lawsuit, b/c it never gets to the point where a verdict is reached. Find some new evidence, some analysis that needs to be done, something to delay, push it out, but keep the lawyer fees accumulating and eventually there will always be a breaking point for the small guy.

On damages, I imagine warzone gets a lot of new players via word of mouth. That’s how I found the game. But now every single time I tell someone about warzone they get confused or at least bring up cod warzone and the conversation often gets sidetracked. It’s also harder to find warzone on google, the App Store, twitch. If you google warzone, it used to be that warzone was the top result, now I can’t even see it in the first 4 pages of the google search.

The warzone category on twitch got hijacked too I think? I think that demonstrates the confusion aswell.

That's a flat-out 100% lie. I never sent a cease and desist or demand they change their name. Activision's entire lawsuit is absurd.

Hard to imagine a big company just straight-up fabricating like that. Their legal department will know the consequences of that, and BigCo legal departments are pretty conservative places.

You might want to make sure that your lawyer didn't write something like that into any of his paperwork.
