yes, the rule is based on the issue of a clan splitting, resulting in the players that gained promotion outside the clan.

In this case the difference is that the clan losing his players agrees to the splitting.

But even if for different motivations, there are players that earned promotions now in another clan, thus this rule applies and they can grab App spot.
