why is there 2 unusable open seats

I suspect you mis-counted. There should be the same number of open seats as the maximum size you can create. See "Number of players you can invite when creating games" at https://www.warzone.com/Unlockables

Or perhaps you're counting yourself as an open seat, and you have something else in your list that's not an open seat that's down below the scrolled area in your screenshot.
