Evil is being aware that what you do is ethically bad yet still doing it.

Being unable to have any sense of right or wrong is a mental illness and, in the event of a crime, will result in you being sent to hospital rather than prison as a sentence.

It links in to the concept of reponsibility. The reason the age of criminal responsibility is what it is (in the UK anyway) is because at that age you supposedly develope a moral awareness.

There are actually a few famous cases on that subject, one in paticular in the USA (leopold and Loeb) when two young guys murdered someone and got off the death penalty on the basis that they were not entirely moraly reponsible (its complicated).

So yes, definitionally, if someone is incapable of making moral decisions they are not evil (or good).

There can be no pure evil in the absence of an arbiter to define what evil is. Many faiths make many claims as to the nature of that arbiter and the rules they want to define for us, but none can be shown to be more correct than the others. Ergo "pure evil" is a term that only applies internally to a system of faith, not externally to society at large. Instead we have Legal/Illegal, Social/Sociopathic, Moral/Immoral, etc.

Therefore, from a Jewish perspective you can call Hitler "pure evil" and be right, or from a rational humanist perspective you can call him "sociopathic" and proscribe medications, and still be right.
