Oh nobody actually answered to MoD's question, so i'm going to try, so MoD i think that in your case (benoit's case should be no-brainer, right?) it depends whether you were willing participant to that action or not, if you were willing participicant i think the answer would be yes, if you were not i think then answer would be no (and the action in question would propably get re-defined)
