Your example about what is or is not an offence makes no sense whatsoever... (And no, I don't mean your violation of trias politika by having government (instead of a judge) send someone to prison; that could just be a translation issue.)
I can't follow your distinction between "disagreeing" and "being against". It feels like you're trying to make a subtle distinction..., too subtle for you to explain in English. (If your native language happens to be Dutch, could you try to explain it again? Unfortunately I myself do not speak any other language well enough to discuss a subtle point.)
